Methodology
Under Ethiopian Labour Proclamation No. 1156/2019 (Articles 39 & 40), an employee who has completed their probation period and whose contract is terminated under qualifying statutory grounds is entitled to severance pay. Basic severance is 30 days’ wages (one month salary) for the first year of service, plus one-third (1/3) of monthly wages for each subsequent year of service. Total statutory severance is capped at twelve (12) months’ wages. Additionally, employees terminated without legal notice are entitled to notice indemnity (1 to 3 months depending on length of service under Article 44), and unlawful dismissal entitles employees to compensation up to 180 days (6 months) wages under Article 43. Unused annual leave must be liquidated in cash based on daily wage (monthly basic / 25 days) under Article 77.

Frequently asked questions
How is severance pay calculated in Ethiopia under Labour Proclamation 1156/2019?
For the first year of service, severance equals 30 times the average daily wage (or one full month of basic salary). For service between 1 and 5 years, add 1/3 of the monthly basic wage for each additional year. For service exceeding 5 years, add 1/2 of the monthly wage for each additional year, subject to a statutory maximum cap of 12 months’ wages.
What is the compensation for unlawful termination in Ethiopia?
Under Article 43(4) of Proclamation 1156/2019, if a contract of employment is terminated unlawfully by the employer and reinstatement is not ordered, the employee is entitled to compensation equal to up to 180 days’ (6 months’) wages, in addition to statutory severance pay and notice period compensation.
What is the required notice period for termination in Ethiopia?
Under Article 44, statutory notice periods given by the employer are: 1 month for service up to 1 year; 2 months for service between 1 and 9 years; and 3 months for service exceeding 9 years. If notice is not served, the employer must pay the equivalent basic wages in lieu of notice.
How is unused annual leave paid upon termination in Ethiopia?
Under Article 77, accumulated unused annual leave cannot be waived and must be liquidated in cash upon termination. The daily wage rate is computed as monthly basic salary divided by 25 working days, multiplied by the number of unused annual leave days.
Is severance pay taxable in Ethiopia?
Severance pay paid upon lawful termination is subject to preferential income tax treatment under the Ethiopian Federal Income Tax Proclamation, where the tax rate is averaged over the years of service.
